Reversal of the § 19 levy 2012 and 2013 in 2014 and 2015
With the adjustment of StromNEV under the amendment of 14th August 2013 the regulations of § 19 para 2 StromNEV were modified. Among others the limits for end consumption named in § 9 para 7 sentences 2 and 3 KWK-G were increased with retroactive effect as from 01st January 2012 to 1,000,000 kWh. This necessitates the reversal of § 19 StromNEV levy for the years 2012 and 2013 and their reassessment in the light of changes in the legal framework.
The system to implement these modified legal regulations of § 19 para 2 StromNEV was agreed with the Federal Network Agency and the Federal Association of Energy and Water (bdew)

Consumption category A’:
End consumer electricity consumption of up to 1,000,000 kWh/year.
Consumption category B’:
End consumer electricity consumption above 1,000,000 kWh/year of consumers that do not belong to consumer category C. Consumers of this category pay for consumption above 1,000,000 kWh/year a reduced §19 StromNEV levy of a maximum of 0.05 ct/kWh.
Consumption category C’:
End consumer electricity consumption above 1,000,000 kWh/year of end users belonging to the manufacturing industry, rail-bound traffic or railway infrastructure with annual consumption leading to electricity expenses of more than 4% of the total turnover of the previous calendar year. Consumers of this category pay for consumption above 1,000,000 kWh/year a reduced §19 StromNEV levy of a maximum of 0.025 ct/kWh.

Consumption category A:
End consumer electricity consumption of up to 100,000 kWh/year.
Consumption category B:
End consumer electricity consumption above 100,000 kWh/year of end users that do not belong to consumer category C. Consumers of this category pay for consumption above 100,000 kWh/year a reduced §19 StromNEV levy of a maximum of 0.05 ct/kWh.
Consumption category C:
End consumer electricity consumption above 100,000 kWh/year of end users belonging to the manufacturing industry, rail-bound traffic or railway infrastructure with annual consumption leading to electricity expenses of more than 4% of the total turnover of the previous calendar year. Consumers of this category pay for consumption above 100,000 kWh/year a reduced §19 StromNEV levy of a maximum of 0.025 ct/kWh.
